This Acceptable Use Policy ("AUP") applies to everyone who uses Cellotel's hosted dialer, phone numbers, and calling services (the "Service"). It forms part of our Terms of Service. Our upstream telecom carriers impose their own acceptable-use rules, and we pass those obligations on to you. If you don't agree to this AUP, do not use the Service.
1. Prohibited uses
You must not use the Service to, and must not allow anyone else to:
- Make illegal robocalls. No calls that use an artificial or prerecorded voice, AI-generated voice, or an automatic telephone dialing system in violation of the Telephone Consumer Protection Act (TCPA, 47 U.S.C. § 227), FCC rules (47 C.F.R. § 64.1200), the FTC Telemarketing Sales Rule (16 C.F.R. Part 310), or any state "mini-TCPA" or telemarketing law.
- Call without consent. No telemarketing or marketing calls to wireless numbers, and no prerecorded or artificial-voice calls, unless you hold the prior express (and, where required, written) consent the law requires. You must be able to produce proof of consent for every number you call within 2 business days of our request.
- Spoof caller ID. No transmitting misleading or inaccurate caller ID information, and no displaying any number you do not own or are not authorized to use (Truth in Caller ID Act, 47 U.S.C. § 227(e)). Only numbers on your Cellotel account, or numbers you have verified as yours, may be used as caller ID.
- Ignore Do-Not-Call rules. No calls to numbers on the National Do Not Call Registry, applicable state DNC lists, or your own internal DNC list, unless a valid legal exemption applies.
- Commit fraud, phishing, impersonation (including of government agencies, banks or utilities), harassment, threats or debt collection that violates the FDCPA or Regulation F.
- Make calls connected with illegal products or services, or any campaign a carrier has identified as prohibited.
- Generate artificial or "pumped" traffic, use the Service for traffic-stimulation schemes, or make calls designed mainly to probe whether numbers are active ("number scrubbing" or "wardialing").
- Resell the Service without our written agreement, or attempt to access other clients' data or our systems.
2. Required practices
- DNC compliance. You must hold your own subscription to the FTC National Do Not Call Registry for every area code you call (if you make telemarketing calls), scrub your lists at least every 31 days, maintain an internal company-specific DNC list, and honor do-not-call requests immediately and permanently (and in all cases within the period required by law).
- Abandoned calls. Keep each campaign's abandonment rate at or below 3% of live-answered calls per campaign per 30-day period. Play the required identification and opt-out message on abandoned calls, and let calls ring for at least 15 seconds or 4 rings.
- Calling hours. Call only between 8:00 a.m. and 9:00 p.m. in the called party's local time, or within narrower hours where state law requires, and observe state restrictions on weekends and holidays.
- Identification. Your agents must promptly identify themselves, your business and the purpose of the call, and provide a phone number at which the called party can reach you.
- Recording disclosure. Where call recording is enabled, comply with all-party-consent state recording laws by disclosing recording at the start of the call.
- Traffic quality. Avoid excessive short-duration calls and calls to disconnected numbers. Keep your lead data clean.
- Cooperation. Respond promptly to traceback requests (including from the Industry Traceback Group), carrier inquiries and our compliance requests.
3. Enforcement
We may monitor call metadata (such as call volumes, durations, answer and abandon rates and complaint reports) to enforce this AUP. We may suspend or terminate any campaign, number or account immediately and without refund if we reasonably believe this AUP or the law has been violated, or if a carrier or regulator requires it. You are responsible for all fines, carrier penalties and surcharges caused by your traffic, and you agree to indemnify Cellotel for claims arising from your calls.
4. Reporting abuse
To report an unwanted call made through Cellotel, email abuse@cellotel.com with the calling number, date and time.
